OVERVIEW

Welcome to Reef Life. The terms "we", "us" and "our" refer to Reef Life. Reef Life operates this store and website, including the information, content, features, tools, products and services made available through it (the "Services"). Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referred to in them, describe the terms on which you may access and use our Services and purchase products from us.

Please read these Terms of Service carefully before using our website or placing an order.

By accessing or using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you should not use the Services.

Nothing in these Terms affects any statutory rights you may have as a consumer.

SECTION 1 – ACCESS AND ACCOUNT

You must be legally capable of entering into a contract in your country or jurisdiction in order to make a purchase from us.

When using our Services or placing an order, you may be asked to provide information including your email address and billing, payment and shipping information. You agree that the information you provide is accurate, current and complete and that you have the right to provide it.

If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to display and describe our products accurately. However, colours and appearance may vary slightly depending on your device, screen settings and the nature of the printing and manufacturing process.

Minor variations between product images and the finished product may occur and do not necessarily constitute a defect. This does not affect your rights where goods are faulty, damaged, misdescribed or otherwise do not conform to your statutory rights.

Product descriptions, availability and specifications may be updated from time to time.

Reef Life designs are released as limited Editions. We may limit quantities, discontinue products or retire an Edition at any time. Once an Edition has been retired, we do not intend to make that design available again, although this does not affect orders already accepted by us.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase the products in your order.

Receipt of an order confirmation does not necessarily mean that we have accepted your order. A contract is formed when we confirm acceptance of your order or begin processing it for fulfilment.

We may decline or cancel an order where there is a legitimate reason to do so, including where a product is unavailable, there has been an obvious pricing or product-description error, payment has not been authorised, we reasonably suspect fraud or misuse, or we are unable to fulfil the order.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

Please check your order carefully before submitting it. If you need to change or cancel an order, contact us as soon as possible. Because our products are produced to fulfil orders, we may not always be able to change an order once production has started. This does not affect any statutory cancellation rights that apply to your purchase.

Products purchased from Reef Life are intended for personal use unless otherwise agreed with us.

SECTION 4 – PRICES AND PAYMENT

Prices may change from time to time, but changes will not affect an order that we have already accepted.

The price applicable to your order will be displayed during checkout and confirmed in your order confirmation.

Applicable shipping charges and taxes will be displayed or calculated during checkout where appropriate.

For international orders, customs duties, import taxes or other charges may apply depending on the destination. Where such charges are not collected by us at checkout, they may be payable by the recipient to the relevant authority or carrier.

You agree to provide accurate and complete payment and billing information and confirm that you are authorised to use the payment method provided.

SECTION 5 – SHIPPING AND DELIVERY

Our products are produced and fulfilled on our behalf by third-party fulfilment providers. Production and delivery times displayed on our website or during checkout are estimates unless we expressly state otherwise.

We will take reasonable steps to fulfil and deliver orders within the timescales communicated to you. Delays can occasionally occur because of circumstances outside our reasonable control, including carrier disruption, customs processing or other events affecting delivery.

For UK consumer orders, and wherever otherwise required by applicable consumer law, products remain at our risk until they come into your physical possession or the physical possession of a person you have identified to receive them, except where applicable law provides otherwise.

SECTION 6 – INTELLECTUAL PROPERTY

Unless otherwise stated, the Reef Life name, branding, artwork, product designs, photographs, graphics, text and other original content appearing through our Services are owned by or licensed to Reef Life and are protected by applicable intellectual property laws.

The Services and their content are provided for your personal, non-commercial use.

You must not reproduce, distribute, modify, commercially exploit or create derivative works from Reef Life content or designs without our prior written permission, except where permitted by law.

Shopify's name, logo and associated trademarks belong to Shopify. Other names, logos and trademarks appearing through the Services belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools or services supplied by third parties.

Where a third-party service is offered separately from Reef Life, your use of that service may also be subject to the third party's own terms and policies.

Nothing in this section excludes or limits any responsibility that Reef Life has to you under applicable consumer law.

We may introduce, change or discontinue features or tools available through our website from time to time.

SECTION 8 – THIRD-PARTY LINKS

Our Services may contain links to websites or services operated by third parties.

We are not responsible for the content or practices of independent third-party websites that we do not operate. If you choose to visit or purchase from a third-party website, you should review that third party's terms and policies.

Nothing in this section affects any responsibility we have for products or services sold directly to you by Reef Life.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Reef Life's online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services online.

Products purchased through our store are sold by Reef Life. Your contract for the purchase of those products is with Reef Life and not Shopify.

SECTION 10 – PRIVACY

Personal information collected through our Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify processes certain personal information in connection with your access to and use of our Services. Other service providers may also process information where necessary to provide services such as payment processing, order fulfilment and delivery.

SECTION 11 – REVIEWS AND FEEDBACK

If you submit reviews, photographs, comments, suggestions or other content to us ("Feedback"), you confirm that you have the necessary rights to provide that content.

Where you submit Feedback for publication or promotional use, you grant Reef Life a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that Feedback in connection with operating and promoting Reef Life and its products.

You must not submit content that is unlawful, defamatory, abusive, misleading, obscene, infringes another person's rights, contains malicious software, or otherwise violates applicable law.

We may moderate or remove Feedback where we reasonably consider this necessary.

SECTION 12 – ERRORS AND INACCURACIES

We try to ensure that information on our website is accurate, but occasional typographical errors, inaccuracies or omissions may occur in product descriptions, pricing, promotions, availability, shipping charges or delivery estimates.

We may correct such errors when identified.

If an error materially affects an order you have already placed, we will contact you where appropriate and provide any options or remedies required by applicable law.

Termination or suspension does not affect rights or obligations that arose before termination and does not affect your statutory consumer rights.

We aim to provide our Services with reasonable care and skill and to supply products that comply with applicable consumer law.

Nothing in these Terms excludes or restricts rights or remedies that cannot lawfully be excluded or restricted.

In particular, nothing in these Terms limits your statutory rights relating to goods that are faulty, damaged, not as described or otherwise fail to meet standards required by applicable consumer law.

While we aim to keep our website available and accurate, we cannot guarantee that access to the website will always be uninterrupted or error-free.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses resulting from circumstances for which we are not legally responsible.

If you use products purchased from Reef Life for commercial or business purposes, we will not be responsible for business losses such as loss of profits, revenue, business opportunity or anticipated savings, except where applicable law provides otherwise.

Nothing in this section affects your statutory consumer rights.

SECTION 18 – YOUR RESPONSIBILITIES

You are responsible for using our Services lawfully and in accordance with these Terms.

You may be responsible for losses reasonably incurred by us as a direct result of your unlawful use of the Services, your infringement of another person's rights, or a serious breach of these Terms, to the extent permitted by applicable law.

Nothing in this section requires a consumer to compensate us for losses for which they would not otherwise be legally responsible.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified to the minimum extent necessary or, where that is not possible, severed from these Terms.

The remaining provisions will continue in effect.

If we do not immediately exercise a right or remedy available to us, this does not mean that we have waived that right or remedy.

These Terms, together with the policies and information expressly incorporated into them, form the agreement between you and us concerning your use of the Services and purchases from Reef Life.

Nothing in this section limits any rights you have under applicable consumer law or prevents you from relying on statements or information that applicable law treats as part of our contract with you.

SECTION 21 – ASSIGNMENT

You may not transfer your rights or obligations under these Terms to another person without our agreement, except where applicable law gives you the right to do so.

We may transfer our rights or obligations under these Terms where reasonably necessary in connection with our business, provided that doing so does not reduce your rights under these Terms or applicable law.

These Terms and contracts between you and Reef Life are governed by the laws of England and Wales.

If you are a consumer resident in another part of the United Kingdom, you retain any mandatory rights and protections available to you under the laws applicable to you, and nothing in these Terms prevents you from bringing proceedings in a court available to you under applicable law.

If you are a consumer outside the United Kingdom, you may also have mandatory consumer rights under the laws of the country or region in which you live. Nothing in these Terms is intended to deprive you of protections that cannot lawfully be excluded by agreement.

We encourage you to contact us first if you have a concern so that we have an opportunity to resolve it.
